Introduction & Scope
Frisbly provides browser-side image, PDF, web, and utility tools. Current file processing is local to the user's browser: Frisbly does not provide public file hosting, user storage, or server-side conversion for uploaded files.
This page explains how Frisbly handles copyright notice and takedown requests if a copyright concern is sent to us, including DMCA procedures under 17 U.S.C. §512 and Korean Copyright Act procedures under Article 103.
For Korean Copyright Act Article 102(1), the current active categories are three categories; item 4 was deleted on February 4, 2020. Frisbly's present no-upload tools do not create user-hosted storage, but notice procedures are published for future or edge-case copyright handling.
DMCA Framework (US)
Under 17 U.S.C. §512(c), a service provider may need to act when it has "actual knowledge" of infringing material or becomes aware of facts making infringement apparent.
When valid notice is received, the provider must "acts expeditiously" to remove or disable access to the material. The framework also addresses direct financial benefit/control and published designated-agent information.
Frisbly will review notices for the required information before taking action, especially because the current product is built around local browser processing rather than hosting user files.
Korean Copyright Act
Korean Copyright Act Article 103 allows a right holder to request interruption of reproduction or transmission from an online service provider after showing the infringement facts.
Article 103-2 is titled "Scope of Court Orders Against Online Service Providers". For qualifying providers, court orders are limited to measures such as removal, access blocking, account termination, or other necessary steps that place the least burden on the provider.
Enforcement Decree Article 40 and Enforcement Rule Article 13 refer to a request form and supporting materials, including materials showing rights, identity confirmation, representative authority if applicable, and a statement route when a false or improper request may create civil and criminal responsibility.
How to Submit a Notice
A DMCA notice should include all six elements required by 17 U.S.C. §512(c)(3)(A)(i)-(vi). Korean notices should also include the materials listed under Enforcement Decree Article 40 and Enforcement Rule Article 13, including Form No. 40 where applicable.
- Physical or electronic signature of the authorized person.
- Identification of the copyrighted work, or a representative list of works.
- Identification of the allegedly infringing material and information sufficient to locate it.
- Contact information for the complaining party.
- A good-faith belief statement that the use is not authorized by the owner, agent, or law.
- An accuracy and authority statement under penalty of perjury.
- For a Korean notice: claimant information, representative proof if applicable, copyrighted-work identification, URL or other location information, rights materials or the Article 40(2) statement, and identity confirmation materials.
Counter-Notice Procedure
A valid DMCA counter notice may require Frisbly to notify the original complainant and wait "10 business days" before restoration.
Under 17 U.S.C. §512(g), restoration may occur after a period "not less than 10, nor more than 14" business days unless the original complainant confirms court action seeking to restrain the subscriber.
- Subscriber signature.
- Identification of the removed or disabled material.
- The former location of the material.
- A penalty-of-perjury statement that the material was removed or disabled by mistake or misidentification.
- Name, address, and telephone number.
- Consent to federal court jurisdiction and acceptance of service from the complainant or the complainant's agent.
Repeat Infringer Policy
Frisbly maintains a repeat-infringer policy intended to be "reasonably implemented" under 17 U.S.C. §512(i).
Where appropriate, Frisbly may limit access, disable a workflow, or terminate an account or access path connected to repeated valid copyright complaints. Frisbly also accommodates standard technical measures where they apply.
DMCA Designated Agent
Frisbly is a client-side image, PDF, web, and utility tool. All file processing runs entirely inside the user's browser, and Frisbly does not host, store, or transmit user-uploaded files on its servers. Therefore, the DMCA Safe Harbor under 17 U.S.C. §512(a)-(d) does not apply to Frisbly's current product, and Frisbly does not maintain a DMCA Designated Agent registered with the U.S. Copyright Office.
Copyright concerns may still be sent to dmca@frisbly.com with the notice fields described above. Frisbly will review each notice in good faith. If Frisbly's product later expands to host user-uploaded content, this section will be updated and a Designated Agent will be registered before that change takes effect.
Korean OSP Recipient
Under Korean Copyright Act Article 103, an online service provider designates a recipient for interruption and resumption requests. Because Frisbly does not host user-uploaded content, the same email channel is used for Korean copyright notices: dmca@frisbly.com.
Notices and counter-notices submitted to this address should include all fields listed in the sections above. Incomplete notices may be returned for correction.
Governing Law & Disclaimer
These procedures are operated by Frisbly under applicable copyright notice-and-takedown laws, while the Terms designate the laws of the Republic of Korea as governing law except where mandatory law provides otherwise.
